General conditions of Contract StampeGrafica.Plus – Level C - Chichén Itzá

Introduction and definitions

StampeGrafica, in the legal representation of StampeGrafica of Bielli Daniel, with registered office in Via Sandro Pertini, 1 Cave (Rm) 00033, Italy, following the order request online, via telephone or at our offices, will work alongside a consultant to each client that, in case of need, will be available for any questions regarding methods of payment, send files, print, delivery times, or invoicing.

Every order placed on www.stampegrafica.plus implies the conclusion of a contract of sale in the Italian language.

The present contract of sale between StampeGrafica and the Customer applies to all buyers who make purchases via internet or at commercial facilities. The General Contract of sale between StampeGrafica and the Customer is wholly applied to all of the Customers that are part of Level C of the Wonder Program, which is the base level of the loyalty Program of StampeGrafica also known as Chichén Itzá.

The Customer will always be informed of your Level in the loyalty Program and will have access to the complete contract (in PDF format) that will indicate clearly the benefits of Group membership. Each group of Customers (different levels in the Loyalty Program) will see the Benefits of contract, more and more, tacitly agreed between StampeGrafica and the Customer.

No. 1 - Processes of order

The management of the order is divided into four different phases where the point 1 indicates the operation of “pre-production” while the points 2-3-4 correspond to the stages of “production”:

1) Pre-production (verification of the accuracy order, check product availability, verification of payments, verification file);
2) Graphics-Processing (processing, print preview, approval, print preview);
3) Printing (creation, printing plants, production);
4) Order Fulfillment (packaging, shipping, billing).

No. 1a - the Beginning of the production

The phases of production (phases No. 2-3-4 of the processes of order) are initiated as a result of the verification of the correctness of the order of the files and the completeness of payments (based on the mode choice).

During the purchase phase, the customer can select different payment methods clearly described in Art. 6 of this contract of sale.

In the case of payments made through Credit Card, PayPal or by cash, the articles selected will be put into production without further delay administrative action, subject to verification of the files and the correctness of the order. For payments by Bank Transfer in advance the production will be started after the crediting of the amount due (usually after 2-3 days).

No. 2 - Cancellation of an order

The customer has the right to request the annulment of the order to StampeGrafica by contacting the consultant. An order may be cancelled only prior to the start of production of the work itself. If, at the time of the cancellation request, the material has already been printed or is in the process of production, the order cannot be canceled (in this case, we recommend that you read theinformation on the right of withdrawal).

No. 3 - order Fulfillment

All orders received are shipped within a maximum period of contract is specified in detail in the "Time of Delivery", except for causes of force majeure and/or fault on the systems. Any delays will be communicated promptly to the Customer. In addition, from the time the goods are delivered to the carrier for transport, StampeGrafica no longer considered responsible in case of non-delivery, delay on the set times or damage to the goods during transport.

No. 4 - Transport and Delivery

StampeGrafica using the expertise and the technical structure of Bartolini SPA. For the customer who wants to, with its own means and/or carriers, to manage the collection of the goods will necessarily have to communicate it to the logistics department (spedizioni@stampegrafica.it) or in the order notes (in the case of a Web order). Article 5 – delivery Costs and stock merchandise

Shipping is FREE for all orders starting from € 149,00 + Vat. For orders below shipping cost is fixed and corresponds to € 12,00 + vat. In the case of stock of shipping, StampeGrafica will contact the recipient to grant a return at the same address, redelivery to another address, the delivery retainer deposit at a branch of the carrier closest to them. The cost of the stock will be charged entirely to the customer within 15 days from the date of delivery.

Article 6 – Prices and payment

The prices of your products www.stampegrafica.plus are expressed in Euro (€) excluding VAT. StampeGrafica reserves the right to change prices at any time, following changes in the market.

We accept as payment:
Credit card, PayPal, Bank Transfer, cash on delivery.

Credit card (PayPal): Paypal allows you to pay through the cards "Visa, MasterCard, Aura, Prepaid PayPal Card and Discover".

Cash on delivery (+ 3%): Up to a maximum of € 1000,00 Vat Included, by cash or cheque on delivery of the goods by the Courier.

Article 7 – Responsibility And Liability

StampeGrafica is not deemed to be liable to the purchaser if this will forward the file incorrect or is not in conformity with the indications provided. Sending files that do not conform may cause delays in the mass production of the product or print quality is not suitable for the standard of StampeGrafica. The technical charts of StampeGrafica are committed to every way to perform a quality check of the files in order to inform the Customer of any eventuality.

In no case StampeGrafica be liable for any damages caused by the delay of the delivery if the delay is attributable, in a way that is clear and demonstrable, carrier, delegate to the transport. Also StampeGrafica will not be liable for any damage or problems mentioned in all the articles of the terms of the contract accepted during the time of the order.

Item 8 - Enter file, graphic material

In case of any inaccuracies, the quality is not suitable, typographical errors, or erroneous information about the files sent, StampeGrafica is deemed to be exempt from all responsibility. The technical charts of StampeGrafica are committed to every way to perform a quality check of the files in order to inform the Customer of any eventuality.

If the user does not proceed to the loading of the file in term of 15 days from the date of the order, the order will be cancelled and the user will be refunded in the event of a confirmed payment and in the case of preliminary work and/or supplies requests have already been made, the refund will be reduced by a penalty, which is shown to the Customer on cancellation of the assignment.

No. 9 - Create print previews

StampeGrafica creates works of graphic design. A team of experts from the art of visual communication and marketing is available to the Customer for the realization of graphic projects, and effective communication. (For works of graphic design refers to the contract performance graphics StampeGrafica).

The Print preview (also known as digital proofs) must be approved by the customer before the step of printing products. However, the colors and the position of the graphical elements may not faithfully reflect (ideally) draft illustrative for technical reasons.

The pictures on wwwstampegrafica.plus are purely illustrative, and may not reflect perfectly the product.

Some of the parameters in the chemical composition of the materials used for the production of our products may vary from year to year. StampeGrafica reserves the right to modify without notice the characteristics present in the description of the product.

Art. 10 - Rights of trademark and copyright

The Customer is solely responsible for any infringement of third party rights, in particular the rights of the author, during the execution of your order. The Customer declares to be in possession of the rights of duplication and reproduction. The Client indemnifies the provider from any claims of third parties due to any infringements of these rights.

No. 11 – Printed Colors

StampeGrafica promises to offer its Customers the best print quality. In any case, the color of the draft submitted by e-mail to the client may differ (slightly) compared to the colors of the advertising material printed. This discrepancy may depend on the settings of the monitor and/or according to the different characteristics of the printing techniques. The colors of a reissue may not be equal to 100% compared to the previous version. This can be caused by different environmental conditions that affect printing (temperature, humidity etc...). In the case in which the difference in print can be traced back to one of these factors is not required for any refund.

No. 12 – e-Invoicing

The budget act of 2018 was expected, by 1 January 2019, the obligation of electronic invoicing for the supply of goods and performance of services. E-invoices addressed to her will therefore be issued only by using the Interchange System (SDI).

The invoice is issued within 48 hours from delivery of the goods and a courtesy copy will be sent via email in PDF format.

Article 13 – Disputes

Pursuant to art. 64 and following of D. Lgs. 206/2005, (Consumer Code), the Client shall communicate to the address reclami@StampeGrafica.it the problem exists documenting the differences with photos or scans, within 10 days from the receipt of the goods. The goods must then be returned at the expense of the customer as provided for in art. 67 paragraph 3 of the "code of Consumption" within 14 days from the date of delivery of the goods (instead of within the 10 days provided by the Code of Consumption). StampeGrafica will reissue correct and the shipment of the goods. StampeGrafica reserves the right to reject any claim if the issue exists, is mentioned in the articles 3, 4, 7, 8, 9, 10, 11 of the conditions of contract accepted during the time of the order of the goods.

StampeGrafica will reprint and/or refund for the goods ordered only in the case in which the problem should be the objective and/or caused by errors of the press , and in the case that the goods received by the purchaser either partially or totally inoperable. Art. 14 – the Processing of personal data

The signing of this agreement authorizes StampeGrafica to the processing of personal data pursuant to D. Lgs. 196/2003 and law EU GDPR (general Regulation on data protection) on the protection of persons and other subjects regarding the processing of personal data. The processing of information relating to the Customer, will be imprinted to principles of correctness, lawfulness and transparency, protecting the privacy and the rights of the user.

For us it is essential to ensure the maximum privacy and fairness in the treatment of your personal data.

No. 15 - the Right of withdrawal

Article 16 – Jurisdiction

For all disputes relating to the interpretation and/or execution of this agreement, the parties recognize the exclusive competence of the court of Tivoli (RM), regardless of the place of conclusion of the contract, the domicile of the buyer, the place of payment or other.
